A pharmaceutical company has been slapped with an illegal recall of its “impotence drug” Viagra, according to a recent court ruling, but the company said it will reimburse a company if the drug is recalled for lack of quality. The company said the recall was due to the drug’s lack of manufacturing and quality control issues and could affect the “marketing, distribution, and sale of the drug.”
The FDA, which regulates pharmaceuticals, has been in the business of ensuring safety and efficacy for over-the-counter and other products.
In 2007, the agency recalled a bottle of the popular erectile dysfunction drug called Viagra, which contained sildenafil, a generic version of the prescription drug used to treat chest pain.
In 2008, the FDA recalled a bottle of the popular erectile dysfunction medication, containing more than $3 billion in worldwide revenue. The FDA said it was concerned about the drug’s safety, but that it was not aware of the recall.
“Although the FDA has not provided specific information about the recall, they did not provide any assurance that the recall will be reversed,” the FDA said in a statement. “We are committed to holding the FDA accountable for its reckless conduct.”
In August 2013, a California court ruled that the manufacturer, Pfizer, had overcharged for Viagra, but the court ruling said the company had not disclosed any information about the recall. The company did not return a message seeking comment.
“The court’s ruling is contrary to the spirit of the Food and Drug Administration’s warning letter, and we urge all regulatory authorities to exercise their respective responsibilities and take prompt enforcement actions to ensure the public’s safety,” the FDA said in a press release.
The FDA said the drug is approved to treat erectile dysfunction and is a popular treatment for premature ejaculation.
The drug is manufactured by Bayer Healthcare, Inc., and it has been available under different brands than its predecessors. In January, the company issued a recall for the drug that had been in the works for more than a year.
The drug has also been recalled for safety reasons. In 2012, a recall for the drug, containing sildenafil, was issued for use in the treatment of pulmonary arterial hypertension. The drug was linked to an increased risk of death among the more than 1,500 people taking it.
In March 2013, the FDA recalled a bottle of the drug containing more than $3 billion in worldwide revenue.
